Insurance Amendment Act 2011 and Insurance Accounts Amendment Regulations 2011

The Bermuda Monetary Authority (the “Authority”) proposes for amendments to be made to the Insurance Act 1978 and related regulations to, amongst other things; take into account general housekeeping matters resulting from consultation with Industry; the rolling in of Class 3A insurers so that such class of insurers will now be subject to enhanced solvency reporting; and other regulatory requirements to align the Authority’s framework with relevant Solvency II initiatives. The deadline for parties to provide comments to the Authority’s proposals is 10th November 2011; all comments are to be sent to policy@bma.bm.

This discussion paper outlines changes proposed by the Bermuda Monetary Authority (the Authority) to its regulatory framework and statutory reporting requirements. In this paper, the Authority is considering the introduction, for solvency purposes, of an economic balance sheet framework for the Bermuda market. The proposals in this paper will apply to the Bermuda commercial insurers (Class4, Class 3B, Class 3A insurers and insurance groups for which the Authority would be the group-wide supervisor. In addition, the concepts in this paper would also be considered for Long-Term commercial insurers.
